Terms and Conditions

1. Definitions

1.1 The term "Client" , referred to as ‘you’ or ‘your’, refers to the Individual or entity who is paying for the tuition service provided by the Tutor. In the context of this Agreement, the Client engages with Dom Payne Tutoring service to receive tutoring services for the Student.

1.2 Tutor: The term "Tutor" OR "The Tutor" refers to Dominic Payne who has been contacted by their Client, Tutoring with Dom Payne Tutoring, for the purpose of providing tutoring services to the Student.

1.3 Student: The term "Student" refers to the individual who is receiving the tuition services provided by the Tutor. The Student is the recipient of the educational support and guidance offered by the Tutor paid for by the Client.

Acceptance of Terms

2.1 Please read these Terms and Conditions carefully before using our online tuition services.

2.2 These Terms govern your access to and use of the online tuition services provided by Tutoring with Dom Payne Tutoring.

2.3 By accessing or using Dom Payne Tutoring, you acknowledge that you have read, understood, and agreed to these Terms, and you represent that you are of legal age to

enter into a binding contract. If you are accepting these Terms on behalf of a minor, you acknowledge that you are the legal guardian or parent of that minor and accept full responsibility for their compliance with these Terms. 

2.4. Any changes or modifications to these terms and conditions are not valid unless they are officially approved in writing by Dom Payne Tutoring.

2.5 Dom Payne Tutoring reserves the right to change these terms and conditions at any time, the most up to date Terms and conditions can be found on the website www.dompaynetutoring.com

2.6 By Continuing to use services provided by Dom Payne Tutoring you are agreeing to comply with and be bound by the following terms and conditions.

3. Services Offered

3.1 The online tuition services include the provision of educational content, tutoring, and related services to help students in their academic studies and development. The specific services, pricing, and schedules will be outlined in your initial consultation with Dom Payne Tutoring.

3.2 Please note Dom Payne Tutoring cannot be held responsible for grades which do not meet the student’s or point person’s expectation.

4. Registration and Account

4 .1 To use our services, you may be required to create an account and provide accurate and complete information about yourself and the student you are enrolling. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

5 Lesson Timings

5.1 Lessons are 45 minutes in duration.

5.2 Lessons can be longer than 45 minutes if agreed by the tutor and client. 

5.3 Please be aware that The tutor might not be able to tutor for longer than our agreed time as this has a knock-on effect on other students and schedule. Each 45 minute session will start promptly and may not be extended if pupils arrive late and other students are waiting for later classes.

6. Scheduling lessons

6.1 The time and date of lessons will be arranged by the Tutor and Client.

6.2 Once the time and date has been established, this time slot will remain with the Client until notice is given by the Tutor or by the Client.  

E.g. If Thursday at 14:00-14:45 has been organised by the Tutor and Client, it will remain the Client’s time slot until further notice is given.

7. Rescheduling lessons & Reminders

7.1 Lessons can be rescheduled at any time, but please give as much warning as possible.  

7.2 Rescheduled lessons have to be used within a 4 week period.

7.3 If a rescheduled lesson has not been used then you will be invoiced 100% of the Tier price.  

7.4 The tutor will send an email or Whatsapp message 12-24 hours before the class to the client to remind them of the lesson. 

 

8. Late arrivals 

8.1 If a student arrives late to a lesson.  The lesson may not be made up afterwards (5.3).

9. Missed lessons/No shows

9.1 If a student does not attend a 1:1 lesson the client will be invoiced 50% of the Tier price.

9.2 If a student does not attend a group class then they will be invoiced 50% of the Tier price and the class will still continue.  

10. Repeated Late Cancellations or No- Shows

10. The tutor has the right to give away the tuition slot if there are continuous late cancellations or no-shows.  

11. Tutor Cancellations

11.1 The tutor agrees to provide tuition for the full duration of the lessons

11.2 The tutor must give 24 hours’ notice where possible when cancelling or rescheduling a lesson.

11.3 If you need to cancel a lesson then you can use Whatsapp or email.  

12. Client obligations

12.1 The Client must provide a quiet environment for the student to access their lessons from.

12.2 The client must ensure that the student has the appropriate equipment for each lesson, including a pen paper.

12.3 The Client must ensure that the Student is set up in the online meetings a few mins before the class is scheduled to start.  

12.4 Clients will receive a recurring lesson link before the first class, which will be used to access each of subsequent classes.

12.5 Students are expected to have their cameras on at all times during the lessons.

12.6 Clients may request specific topics or objectives for 1:1 lessons but please give as much notice as possible so the Tutor can prepare.  

12.7 For Students under 18, an adult must be present in the house during online lessons for safeguarding reasons.

12.8 Clients must ensure that students are fully dressed during all lessons.

13. Tutor Obligations

13.1 Tutor agrees that all lessons will be delivered to the Students at a professional standard.

13.2 The Tutor is responsible for planning and delivering lessons which are tailored to the individual needs of the class.  

13.3 The Tutor will deliver online lessons via Zoom.

13.4 The Tutor reserves the right to report behaviour problems during the lessons to the Client.

13.5 The tutor must report any concerts about a Student’s safety or wellbeing to the local Safeguarding lead.  

14. Additional Services

14.1 Parent meetings can be arranged with The tutor and Client

14.2 Group lessons may be recorded for later viewing.  By agreeing to the Terms and

Conditions, Clients give their permission for Student’s to be recorded and shared if necessary, unless otherwise stated.

15. Termination of Services.

15.1 Lessons will continue until mutually agreed termination date, with either party having the right to terminate.

16. Privacy

16.1 The Privacy Policy outlines how we collect, use and protect your personal information. By using our services you consent to the practices described in the privacy policy.   

17. Limitation of Liability

17.1 To the extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential or special damages arising from or in any way related to your use of our services, even if we have been advised of the possibility of such damages.

17.2 While the Tutor aim’s for student progress, they cannot guarantee academic success and are not liable for academic outcomes.

17.3 The Tutor accepts no liability for direct or indirect losses, damages or errors in learning material.  

18. Invoices, Billing & Payments

18.1 Invoices are sent at the end of the month.  You will be invoiced on the amount of lessons for that particular month.  

18.2 If lessons have been agreed for more than 45 minutes then the payment of lessons are calculated per 45mins.  E.g. if a lesson is 90 minutes long and you have chosen Tier 3, 33.  A lesson would be 66 for 90 minutes.  

18.3 For EU and International residence: A payment link will be sent to your email or Whatsapp number using Wise.com

18.4 For UK residence: An invoice will be sent to your email with the relevant bank details OR a Wise.com payment link.

19. Changes of Terms

19.1 Dom Payne Tutoring reserves the right to update these Terms at any time.  Any changes will be posted on the website.  It is the Clients’ responsibility to review these Terms periodically for changes.

Only necessary information, including but not limited to your home address, payment, contact information, learning styles and preferred times etc. is collected in order to serve the academic needs of our students.

All personal information collected by Dom Payne Tutoring is stored in a secure location with access only granted to the admin. Dom Payne Tutoring will not disclose nor sell/distribute any information obtained or provided by a client to a third party.

Log Data

We want to inform you that whenever you visit our website, we collect information that your browser sends to us called Log Data. This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser version, pages of our Service that you visit, the time and date of your visit, the time spent on those pages, and other statistics. Dom Payne Tutoring uses the aforementioned analytics with the objective of improving the overall quality of its services.

Dom Payne Tutoring website employs the use of “Cookies’ to provide a customised experience for our clients. Cookies are files with a small amount of data that is commonly used as an anonymous unique identifier. These are sent to your browser from any website you visit and are stored on your computer’s hard drive. Cookies are not intended for malicious use and do not deploy viruses to your computer.

The intended use of cookies on our website is to offer clients a convenient access back to our website as well as for you to retrieve data you have entered for any of your subsequent visits.
You have the option to either accept or refuse cookies. If you choose to refuse our cookies, you may not be able to use some portions of our Service.

We may employ trusted third-party companies and individuals to perform the following functions on behalf of Dom Payne Tutoring: To facilitate our Service, To perform Service-related services; or, To assist us in analysing how our Service is used.  Third party vendors are prohibited from using personal information unless it pertains to the services they are providing to Dom Payne Tutoring.

We value your trust in providing us your Personal Information, thus we strive to use commercially acceptable means of protecting our website with features such as a secure socket layer protection encryption. It is however important to be aware that no method of transmission over the internet or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security. In order to protect our vulnerable sector, we ask if you are aged 16 and under, that you do seek permission from your parents before providing us with any personal information.
